Southern Environmental Law Center files notice to sue Progress Energy

The Southern Environmental Law Center has filed a notice to sue Progress Energy, claiming its Asheville Steam Electric Plant, located in Asheville, N.C., is violating the Clean Water Act.

The notice was sent on behalf of the Sierra Club, the Western North Carolina Alliance and Waterkeeper Alliance, and states intent to file a civil action in federal court within 60 days from the date of filing on Jan. 24, 2013 unless other action is taken. Any action to prevent the lawsuit being filed would require Progress Energy to enter a binding agreement to “cease and remediate promptly” any violations to the Clean Water Act, according to the notice.
