Zep Solar sues Westinghouse Solar for patent infringement

Zep Solar Inc. sued Westinghouse Solar Inc. (NASDAQ: WEST), Light Way Solar and three other parties for patent infringement Dec. 21. The patent covers many of Zep Solar’s products.

The suit also names additional Westinghouse business partners, including Light Way Green New Energy Co. of China, it’s US subsidiary, Brightway Global LLC; Morrison Supply Co., Sky Solar Solutions LLC, and Alternative Power & Electric.

Zep Solar is petitioning the US District Court for the Northern District of California to award enhanced damages for willful infringement and issue preliminary and permanent injunctions barring Westinghouse and the other defendants from infringing through the licensing, manufacturing, importation, offering for sale, sale, or use of Westinghouse’s PV modules and installation hardware, including the Westinghouse Solar Power Systems AC-230/235 product family, Andalay Groove components, and others.

Westinghouse in October filed a complaint with the International Trade Commission accusing Zep Solar and Canadian Solar of infringing on two of the company’s solar technology patents. Westinghouse claims U.S. and international patents were applied for the products starting in 2004.
