Westinghouse Solar alleges that it pioneered the Andalay solar panels, in which the racking, grounding and wiring is integrated into the solar panel itself. Starting in 2004, U.S. and international patents were applied for the products.
The company alleges in its complaint that Zep Solar and Canadian Solar make and import certain products that infringe on two of the patents. The filing asks for an investigation into both companies, an exclusion order barring certain Zep Solar and Canadian Solap products from being imported into the U.S. and a cease and desist order prohibiting the importation, sale or advertising of these products.
The ITC may begin a formal investigation on behalf of the U.S. government within the next 30 days.
