Norman Bay is Obama's latest nominee to head FERC

The White House announced President Barack Obama's selection of Norman Bay as his nominee to head the Federal Energy Regulatory Commission (FERC). The nomination requires approval of the Senate before becoming final.

Bay is currently FERC's head of enforcement, and would replace acting chairman Cheryl LaFleur. LaFleur stepped in to cover for retiring chairman Jon Wellinghoff.

Bay is Obama's second pick to replace Wellinghoff. Colorado electric power regulator Ron Binz withdrew his name from consideration for the post in October 2013 after a contentious Senate hearing and the loss of support from several senators.

Bay has been the director of the Office of Enforcement since July 2009. Before joining FERC, he was a Professor of Law at the University of New Mexico School of Law, where he taught criminal law, evidence and constitutional law.

Bay served in the Department of Justice from 1989 to 2001. From 1989 to 2000, he was an assistant U.S. attorney in the District of Columbia and New Mexico. From 2000 to 2001, he was the U.S. attorney in the District of New Mexico, having been nominated by President Bill Clinton and confirmed by the Senate.

Prior to his Justice Department service, Bay was an attorney-adviser in the Office of Legal Adviser at the State Department. He also clerked for the Hon. Otto R. Skopil of the U.S. Court of Appeals for the Ninth Circuit in Portland, Oregon.
